Autumn Statement Brings More Woe For PI Claimants

The Chancellor yesterday made a shock announcement during his Autumn Statement, when he announced his proposed plans to raise the small claims limit for all personal injury claims to £5000 and to place a ban on the awarding of general damages for ‘minor’ soft tissue injuries in road traffic claims.

The devil may well be in the detail but at first glance the headlines do not make good reading for personal injury claimants or their lawyers, with many predicting doomsday for many firms, who are already facing difficulties in adapting to the many legislative changes recently introduced.

We at Tri Star Costs are all in favour of measures that may help curb the number of fraudulent claims, which is apparently the reason behind this announcement, but we fail to see how potentially taking experienced solicitors and lawyers out of the mix, will have the desired effect.

Instead this announcement appears likely to further affect access to justice for thousands of people and is likely to be seen as another victory for the insurance industry over innocent and genuine victims of negligence.

Tri Star Costs will strongly appose these planned legislative changes.
